EDMONTON (660 NEWS) – Two years after filing a human rights complaint against a single father, an Edmonton babysitter is backing down.
James Cyrynowski filed the case claiming the dad violated his rights when he asked about his age, gender, and whether he had children of his own.
“The sad reality is that this complainant is still proceeding with quite a similar complaint against another Edmonton area parent,” said Marty Moore, the lawyer representing the father.
Cyrynowski filed a complaint against an Edmonton couple earlier this year after they posted an ad on Kijiji looking for someone to watch their kids. When Cyrynowski replied, he was asked if he had children of his own. When the family hired someone else, Cyrynowski filed the complaint claiming discrimination.

Moore is now calling for changes to prevent frivolous complaints like this from coming forward.
“I think what needs to happen here is the human rights commission needs to have a higher threshold for accepting complaints to ensure that they have a lot more legitimacy than this complaint did.”

The Justice Centre for Constitutional Freedoms is representing the couple in the other complaint. They say parents should have the right to choose who looks after their children and ask any questions they want of potential candidates.
Last August, the centre asked for the complaints against the couple to be thrown out.
